1. Acceptance of Terms

By subscribing to, accessing, or using any internet services provided by APEX Business Consultants LLC, doing business as NovaLink Fiber (“NovaLink,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and NovaLink. If you do not agree to these Terms, you must not subscribe to or use our services.

2. Service Description

2.1 Internet Services

NovaLink provides residential and business fiber-optic internet access services (“Services”) at various speed tiers, currently including:

  • Spark Plan: Up to 100 Mbps symmetrical
  • Blaze Plan: Up to 500 Mbps symmetrical
  • Supernova Plan: Up to 1 Gbps (1000 Mbps) symmetrical
  • Hypernova Plan: Up to 2 Gbps (2000 Mbps) symmetrical

2.2 Service Availability

Services are available only in areas where NovaLink has deployed fiber-optic infrastructure. Service availability is determined on an address-by-address basis. We reserve the right to decline service requests in areas where infrastructure is not available or where technical limitations prevent reliable service delivery.

2.3 Speed and Performance Disclaimers

Advertised speeds represent maximum capabilities, not guaranteed speeds. Actual speeds may vary based on:

  • Network congestion and overall internet traffic
  • Customer equipment capabilities and configuration
  • Number of devices connected simultaneously
  • Distance from Optical Network Terminal (ONT)
  • Quality of internal wiring and home network setup
  • Websites or services being accessed
  • Time of day and peak usage periods
  • WiFi interference and signal strength

NovaLink makes commercially reasonable efforts to deliver advertised speeds but does not guarantee specific upload or download speeds at all times.

2.4 Service Interruptions

NovaLink does not guarantee uninterrupted or error-free service. Service may be temporarily interrupted for:

  • Scheduled maintenance (advance notice provided when possible)
  • Emergency repairs and network improvements
  • Circumstances beyond our control (power outages, natural disasters, third-party network issues)
  • Security incidents or network abuse mitigation

We will make reasonable efforts to minimize service disruptions and provide advance notice of scheduled maintenance.

3. Service Plans and Pricing

3.1 No-Contract Service

NovaLink services are provided on a month-to-month basis with no long-term contract required. You may cancel service at any time in accordance with Section 8 (Cancellation and Termination).

3.2 Two-Year Price Lock Guarantee

Your monthly service rate is locked for 24 months from your service activation date. We will not increase your monthly service fee during this two-year period, except:

  • If you voluntarily upgrade to a higher-tier plan
  • If you add optional services or features
  • For applicable taxes, fees, and government-mandated surcharges

After the initial 24-month period, standard monthly rates apply, and pricing may be adjusted with 30 days’ advance notice.

3.3 Pricing Transparency

Your monthly service fee includes:

  • Internet access at your selected speed tier
  • Use of NovaLink-provided equipment (ONT and router)
  • Unlimited data with no overage charges
  • 24/7 customer support access

Additional fees that may apply:

  • One-time installation fee (disclosed prior to installation)
  • Equipment replacement fees for lost or damaged customer-responsible equipment
  • Late payment fees (see Section 4.5)
  • Service call fees for customer-caused issues (see Section 5.4)

There are no hidden fees, data caps, or throttling for normal residential use.

3.4 Rate Changes

NovaLink reserves the right to change service rates for new customers or after your two-year price lock period expires. Any rate increase affecting your account will be communicated in writing at least 30 days in advance. Rate decreases may be applied without advance notice.

4. Billing and Payment

4.1 Billing Cycle

Services are billed monthly in advance. Your billing cycle begins on your service activation date and continues on the same day of each subsequent month.

4.2 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express, Discover)
  • Debit cards
  • ACH bank transfer/electronic check
  • Check or money order (by mail)

Automatic payment via credit card or ACH is strongly encouraged to ensure uninterrupted service.

4.3 Autopay Enrollment

By providing payment information, you authorize NovaLink to automatically charge your payment method on or about your billing date each month. You may cancel automatic payments at any time by contacting customer support at least 3 business days before your next billing date.

4.4 Payment Due Date

Payment is due upon receipt of your monthly invoice. If payment is not received within 15 days of the invoice date, your account will be considered past due and subject to late fees and service suspension.

4.5 Late Payments and Rejected Payments

Late Payment Fee: A late fee of $10.00 will be assessed if payment is not received within 15 days of the invoice date.

Rejected Payment Fee: A fee of $25.00 will be charged for any payment rejected due to insufficient funds, closed accounts, or invalid payment information.

Service Suspension: If payment is not received within 30 days of the invoice date, your service may be suspended without further notice. A reconnection fee may apply to restore service.

4.6 Billing Disputes

If you believe your bill contains an error, you must notify us in writing within 30 days of the invoice date. Provide your account number, a description of the disputed charge, and any supporting documentation. We will investigate and respond within 15 business days.

Failure to dispute a charge within 30 days constitutes acceptance of the charge.

During a billing dispute investigation:

  • You must continue to pay all undisputed charges
  • We will not suspend service for non-payment of the disputed amount
  • If the dispute is resolved in your favor, we will credit your account
  • If the dispute is resolved in our favor, the full amount becomes due immediately

4.7 Taxes and Regulatory Fees

Your invoice may include applicable federal, state, and local taxes, as well as regulatory fees and surcharges. These amounts are subject to change based on government requirements and are not included in your base service rate or two-year price lock.

4.8 Refund Policy

No refunds or credits are provided for:

  • Partial-month service (if you cancel mid-billing cycle)
  • Service interruptions lasting less than 24 consecutive hours
  • Downtime caused by customer equipment, wiring, or configuration issues
  • Failure to notify us of service issues

Credits may be provided for:

  • Service outages lasting 24+ consecutive hours (prorated daily credit)
  • Billing errors confirmed through dispute process
  • Discretionary service recovery gestures (case-by-case basis)

5. Equipment

5.1 NovaLink-Provided Equipment

NovaLink provides the following equipment necessary for service delivery:

Optical Network Terminal (ONT): Converts fiber-optic signals to ethernet. Installed at your premises and remains the property of NovaLink.

WiFi Router (Optional): Provided for your use during service. Remains the property of NovaLink.

5.2 Equipment Ownership and Return

All NovaLink-provided equipment remains our property. Upon service cancellation, you must return all equipment within 30 days in good working condition, normal wear and tear excepted.

Unreturned or Damaged Equipment Fees:

  • ONT: $350 unreturned or damaged beyond repair
  • WiFi Router: $150 unreturned or damaged beyond repair

Equipment must be returned to:

  • NovaLink Fiber, 101-4 Chrissa Dr, Pottsboro, TX 75076
  • Equipment drop-off locations (check website for current locations)

5.3 Bring Your Own Device (BYOD)

You may use your own router instead of NovaLink-provided equipment. If you choose BYOD:

  • You are solely responsible for router configuration and troubleshooting
  • NovaLink cannot remotely troubleshoot or configure your equipment
  • Technical support is limited to verifying service delivery to the ONT
  • Equipment compatibility is your responsibility

The ONT must remain NovaLink equipment and cannot be replaced with customer-owned devices.

5.4 Equipment Support and Replacement

NovaLink-Provided Equipment:

  • Defective equipment will be replaced at no charge during the first 60 days of service
  • After 60 days, replacement due to manufacturer defect is provided at no charge upon verification
  • Replacement due to customer damage, loss, or misuse: router replacement fee $150, ONT replacement fee $350

Customer-Owned Equipment:

  • NovaLink provides no warranty, support, or replacement for customer-owned routers
  • You must contact the equipment manufacturer for technical support

5.5 Installation and Access

Professional Installation:

  • NovaLink provides professional fiber installation to your premises
  • Installation includes running fiber to your location, installing the ONT, and configuring service
  • Standard installation fees apply (disclosed before scheduling)
  • You grant NovaLink and its contractors access to your property as needed for installation, maintenance, and repair

Installation Timeline:

  • If service is available at your address, installation can typically be completed within 72 hours of service order
  • Installation appointments are scheduled based on technician availability
  • Our trained technicians can complete most installations in 3 hours or less

Access Requirements:

You agree to:

  • Provide access to installation locations during scheduled appointments
  • Ensure someone 18+ is present during installation
  • Permit access for maintenance and repairs with reasonable advance notice
  • Not relocate, modify, or tamper with NovaLink equipment

6. Acceptable Use Policy

Your use of NovaLink services is subject to our Acceptable Use Policy (AUP), which is incorporated into these Terms by reference. The AUP prohibits illegal activities, network abuse, security violations, and activities that harm our network or other customers. Violation of the AUP may result in:
  • Temporary suspension of service
  • Permanent termination of service without refund
  • Legal action and cooperation with law enforcement
  • Liability for damages caused by your violation

7. Privacy and Data Collection

NovaLink collects, uses, and protects your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We collect information necessary to provide service, including:
  • Account and contact information
  • Service usage data and network performance metrics
  • Payment and billing information
  • Technical support interactions

8. Cancellation and Termination

8.1 Customer Cancellation

You may cancel service at any time without penalty or early termination fees. To cancel:

Cancellation Requirements:

  • Provide account number and service address
  • Specify desired cancellation date (must be at least 24 hours in advance)
  • Return all equipment within 30 days (Section 5.2)

Cancellation Processing:

  • Service will be disconnected at 11:59 PM on your specified cancellation date
  • You will be billed for the full month in which cancellation occurs (no prorated refunds)
  • Final bill will include any outstanding charges, late fees, or equipment fees
  • Equipment must be returned to avoid unreturned equipment charges

8.2 NovaLink Termination Rights

NovaLink reserves the right to suspend or terminate your service immediately without notice for:

Nonpayment:

  • Payment more than 30 days past due
  • Repeated rejected payments or insufficient funds
  • Failure to resolve billing disputes

Policy Violations:

  • Violation of Acceptable Use Policy
  • Fraudulent or illegal use of service
  • Providing false information during signup or service use

Abuse or Harassment:

  • Verbal abuse, threats, or harassment of NovaLink employees, contractors, or representatives
  • Physical threats or violence toward personnel
  • Repeated frivolous complaints or bad-faith disputes

Technical Violations:

  • Tampering with, relocating, or damaging NovaLink equipment
  • Reselling or redistributing service without authorization
  • Operating a public WiFi hotspot on residential service plans (business plans required)

Service Area Changes:

  • You move to an address where NovaLink service is not available
  • Infrastructure in your area is decommissioned or no longer operational

8.3 Post-Termination Obligations

After service termination:

  • All outstanding balances become immediately due
  • Equipment must be returned within 30 days
  • You may be billed for the full month in which termination occurs
  • Access to customer portal and email addresses (if provided) will be disabled

8.4 Service Restoration

If service is terminated for nonpayment or policy violation, restoration requires:

  • Payment of all outstanding balances in full
  • Payment of any applicable reconnection fees ($50-$150 depending on circumstances)
  • Agreement to comply with all Terms and policies going forward
  • At NovaLink’s discretion, a security deposit may be required (typically equal to two months’ service)

9. Limitation of Liability

9.1 Service Disclaimers

NOVALINK SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

NovaLink does not warrant that:

  • Service will be uninterrupted, error-free, or secure
  • Any specific speed, bandwidth, or performance level will be achieved
  • Content accessed through our service is accurate, complete, or lawful
  • Third-party websites or services will be accessible

9.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVALINK SHALL NOT BE LIABLE FOR:

Indirect or Consequential Damages:

  • Lost profits, revenue, or business opportunities
  • Loss of data or information
  • Costs of substitute services
  • Damage to reputation
  • Any indirect, incidental, special, or consequential damages

Direct Damages Cap:

For any claims arising from these Terms or your use of service, NovaLink’s total liability shall not exceed the amount you paid for service in the three (3) months immediately preceding the claim.

9.3 Exceptions to Limitations

The above limitations do not apply to:

  • Liability that cannot be excluded under applicable law
  • Death or personal injury caused by NovaLink’s gross negligence
  • Fraud or fraudulent misrepresentation
  • Violations of consumer protection laws that prohibit liability limitations

9.4 Third-Party Content and Services

NovaLink is not responsible for:

  • Content, services, or websites accessed through our internet service
  • Viruses, malware, or security threats from third-party sources
  • Actions of other internet users or websites
  • Copyright infringement by users of your connection

You are solely responsible for your online activities and content you access or transmit.

9.5 Force Majeure

NovaLink is not liable for delays or failures in service delivery caused by circumstances beyond our reasonable control, including:

  • Natural disasters (floods, earthquakes, severe weather)
  • Acts of war, terrorism, or civil unrest
  • Power outages or utility failures
  • Third-party network failures or internet backbone issues
  • Government actions, regulations, or restrictions
  • Labor disputes or strikes
  • Pandemics or public health emergencies

10. Dispute Resolution and Legal Terms

10.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action related to these Terms must be brought in state or federal courts located in Brazos County, Texas.

10.2 Informal Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting NovaLink customer support. We will work in good faith to resolve your concerns within 30 days.

10.3 Class Action Waiver

You agree to resolve disputes with NovaLink on an individual basis only. You waive any right to participate in class action lawsuits, class arbitrations, or representative proceedings against NovaLink.

Exception: You may opt out of this class action waiver by sending written notice within 30 days of service activation to 101-4 Chrissa Dr, Pottsboro, TX 75076.

10.4 Statute of Limitations

Any claim arising from these Terms or your use of service must be filed within one (1) year from the date the claim arose. Claims filed after this period are permanently barred.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the Acceptable Use Policy and Privacy Policy, constitute the entire agreement between you and NovaLink regarding service. These Terms supersede any prior agreements, representations, or understandings, whether written or oral.

11.2 Modifications to Terms

NovaLink reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. We will provide notice of material changes via:

  • Email to your account email address
  • Notice on your monthly invoice
  • Prominent notice on our website

Your continued use of service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you may cancel service in accordance with Section 8.

11.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

11.4 Waiver

NovaLink’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized NovaLink representative.

11.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without NovaLink’s prior written consent. NovaLink may assign these Terms or any rights hereunder to any affiliate, successor, or purchaser of our business without your consent.

Notices are considered delivered 24 hours after email transmission or 3 business days after mailing.

11.7 Survival

Sections that by their nature should survive termination of these Terms will survive, including: payment obligations, equipment return requirements, limitation of liability, dispute resolution, and general provisions.

11.8 Relationship of Parties

These Terms create a service provider-customer relationship only. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and NovaLink.
